This Is Enough
Published December 17th, 2005 in General, Tech, PoliticsOk this is enough, for a few months now, the Music Publishers’ Association or “MPA” have been taking down guitar tab and lyric websites. David Israelite, president of the National Music Publishers’ Association, expressed his so-called “concerns” by saying: “Unauthorised use of lyrics and tablature deprives the songwriter of the ability to make a living, and is no different than stealing…” This is insane. Since when has it been illegal for musicians to learn to play each other’s songs?
Another issue that hits pretty close to home with me is that of a piece of software called “PearLyrics.” All this software did was allow you to easily search for song lyrics for whatever song you were currently playing on your computer or any song you wish really. But the higher-ups somehow confused this with violating some sort of law and had the small programmer behind PearLyrics shut down. Keep in mind that all the program did was search websites that were already on the internet and give that information to the user in a readable, manageable way.
A Warner Chappell statement said the company wanted to ensure songwriters were “fairly compensated for their works and that legitimate sites with accurate lyrics are not undermined by unlicensed sites”.
Organizations like Warner Chappell and the MPA have pushed this too far. They have taken a simple battle for monetary profit off artistic works and turned into a global war against information freedom. If we, the netizens, music nerds, and users of the internet allow this type of thing to go on any longer, we will be facing a situation no different then when you tried to wear you favorite t-shirt with the words “BUCK FUSH” on it into your 9th grade science class and were promptly asked to leave. The internet is freedom, that has always been its purpose and idea. That we, the people of the world, could control how and when we get information. I’m almost amazed when I hear stories like this of small companies and websites that work REALLY hard to provide quality content getting shut down because some corporate figure head decided it would make him look good. These types of sites are NOT the reason your industry is losing money. The reason you’re losing money is because you’re spending all of your time trying to stop the inevitable.

I agree. The media businesses are trying to figure out how to co-opt the internet as altnerate distribution. They see projections of iTune’s selling over billion songs in 2006 and think: Damn.. we need to get control of this ‘internet’thing…. And they will! IF we stand by and do nothing. I’m with Lorenzo about not buying music.. I’m done with that… I’m going with indie/unsigned musicians only from now on.. but I’ll pay THEM.. directly. No more ’signed’ bands for me.

I’d still like a formal response from the MPA and/or Warner Chappell directly about how lyric websites are taking profit away from artists, and would love for one of these sites to take them to court over it.

If these guys keep it up, they’re gonna get themselves screwed. These are a bunch of top level execs who have pretty much no technological experiences. By shutting down guitar tab sites, they’re only HURTING the bands, not helping.
Think of it like this: A cover band wants to play a song by a “signed” band. They go to search for guitar tabs for it, but can’t find any, so they don’t play it. If they were able to find the tabs for that specific song, they would have been promoting it by playing it. Someone who wouldn’t necessarily have heard the song could have found it to be pretty catchy, and they’d go out and buy the album.
So there, these dang MPA exec’s are just screwing themselves. *shakes head*… morons.

I agree, I no longer buy anything from the a**clowns. I love the tab sites and this is just another reason for me to shun the whole industry. If there ever comes a time that we can apply payback that hurts them I’m in.

i believe file sharing may be the only answer to this. localised servers are too easy a target for this. a secure (no chance of being sued!) system that would allow people to share tabs is www.hamachi.cc, i think everyone should check this out.

This is so jacked it ain’t funny. Even as a newbie guitarist, the few times I asked a band where I could get tabulature, they all said “go to mxtabs.net”

This is the last straw! The Industry cant stand that they no longer have the ability to control what we do. Tablature is not stealing music!!! Sure I can figure it out by ear, but sometimes the tab helps for those rough spots. What’s the difference if I learn it by ear or from Tab? The end result is still the same (me being able to play the song). If that’s the case then they better start going after every garage band in the world that plays cover songs for fun.

i think that they are being overly aggressive as well. but, all in all. the lyrics and tabs are protected by copywright as well. Go in to any music or music instrument store an dyou will see Books for sale of Lyrics and Tabs.

I remember back in the late 70’s early 80’s when i used to shop in places like that, they all had Signs on the Book racks Saying that NO Sheet Music may be returned.
Because, get this. people used to use a copy machine that was called a Xerox machine. to copy the music then people would return the sheet music for the refund.

I would like to see a full boycott of all major commerical music labels, their is tons a great independent music out there that is far better. With a very few exceptions.
This is crazy!!! I learned a few songs this way, I’m no expert out in the bars, just some guy having fun with the old 6 string. Wait untell instrament makers start to loose sales as no one has any thing that you can play legaly at home for fun. So why buy the instrament any way.

First off Not buying Signed bands albums will NOT fix the problem, Why make the bands suffer by not giving them money when that is their only living, What should be done however is someone to simply take the matter to court , it would be a easy victory , Its words , Not money, Lyrics should be free , Tabs should be free. But not buying some ones album because they are signed shows rash mental judgement and more or less a small knowledge of the music industry. If everyone stopped buying records the music industry would collapse and then you’d have no one MAKING Albums for you to steal. What would you do then?

Go to the band’s website, where they would have a store, or an agreement with a music service like iTunes etc, to sell their songs. Artist’s take = 100% minus cost of online. Music labels would be irrelevant.
Not buying signed bands doesn’t make sense. If you like the band then buy their music. Piracy isn’t the solution; that’ll come when bands wrap up their contacts with major labels and say “You know what? We’re not re-signing with you. Our fans can find us online. Say buh-bye to the stockholders for us.”
I’m sick of this. As a guitar player I find this VERY angering. It will be a cold day in hell before they take down all. What about the artists? Popular bands are going to loose an un-imaginable amount of money over this, people are just not going to bother because of the threats from the sad and stupid corporate money-grubbing pigs.

Firstly not buying signed bands albums doesn’t make a difference really, from the money that is produced by record sales a PITIFUL amount goes to the artists themselves, especially if they are smaller or more ‘independent’ artists. The best way to support these artists is to buy merchandise, come out and represent at shows etc. This is how the recording industries bullsh(ts people into believing that the artists will suffer if we don’t continue to purchase music - LIES! Recording Industry Associations would crumble and fall to the ground (or possibly not something quite so drastic, ha) , leaving formerly powerful and wealthy executives with not quite so much to pad their pockets.
Artist should be publishing and distributing their material on the net, and cut these middlemen right out of the picture. there does not seem to be enough profit for these companies to satisfy them. how can up and coming young people wanting to become musican going to learn and play music if they can not even search for it on the web.

1. they could buy the sheet music, or
2. they could buy the recording and figure it out by ear, which will teach you more in the long run.
I agree with you that artists should self-publish and self-distribute now. Perhaps they could even put out authorized tabs online.
Just say no. Make your own music. Get instruments. Take care of them. Experiment.
Invent new musics and new sounds. You don’t need the music industry. You have an imagination. Your head and heart are full of music. Infinite dimensionalities are full of music. The music business is insignificant.

How do they know that all the Tabs on a particular site are copied out of some tab book. I would say that the majority have been worked out by musicians wanting to play their latest favourite, because a far proportion of them are wrong anyway. @Tom: This is ridiculous. Where exactly am I able to buy Tabs and Lyrics? First there are a lot of artists and songs without songbooks and second there are the overpriced ones which are somethimes more expensive than the CDs itself. Music is a part of culture. AFAIK the music industry is not loosing any money at all since at least 2-3 years ago and in the USA.
I live off music, almost literally. I cannot stand having music playing at some point, but as i dont have the money to buy CDs i download all my music, or get it off friends. I can understand them getting down on COMPANIES downloading masses of music and then selling it as their own. But individuals downloading music is acceptable. THIS however, is beyond riDICULOUS! Do they have any idea how much money it costs to buy a sheet music book? And thats just for the mainstream bands! What about those of us wanting to play Cradle of Filth? Or Murderdolls, or Wednesday 13? We’re screwed! And those that cant READ sheet music? Nuh…this has got to be the stupidest thing i have heard since John Howard said that we dont have a race problem in Australia. Lyrics cant be bought, and nor can tabs. According to the ARIAs, artists are only losing 4% of their sales per year due to downloading of their music. They dont lose ANY from looking up tabs and lyrics on the internet!

Most of those tabs online are created by musicians who learned it themselves by ear and wrote it down. They didn’t copy it from a copyright tab book and they don’t claim to have written the songs. Most importantly, they don’t get any money for having taken the time to tab the songs out. There is no copyright infringement. It’s just for the love of the songs which they have already purchased.
It’s funny how they get all the websites shut down because the artist is losing money, but they’re not exactly busting their asses to provide their own legitimate, licensed sites that the artist would benefit from to replace them. I mean, obviously there’s a need/want for these sites and so much so that the RIAA & MPA see’s them as a threat.

Why don’t they go out to sue unoriginal and deivative copiers who make millions off genuine artists work. I’m thinking Madonna with her current Abba rip-off. I think my favorite point in this whole debate comes from the people saying that tab sites are infringing copyright because tabs are available in published formats.
I’m sure that most people who hear one song that they want to learn will run out and blow $15-$20 on a book for the whole damn album that it’s from. Brilliant.

the best way the musicians could distribute the lyrics(and tab too for that matter) would be to include it with the cd and then make it wort while for consumers to buy again instead of just downloading,

THANK YOU DAVID OWEN. Honestly, I’ve tried learning songs with tab, but about 5 minutes into it i end up changing the rif about 24 times until its not even close and its more my style. Shouldnt rock and roll be about the progression (and maybe a lil tribute to the past)? Seriously, 90% of the music out now is F’ing terrible at best. Whiney punk DoucheBags and stiff-wristed guitarists bangin’ out power chords while their drummer does all the work. I honestly cant stand it. It’s really time for a new old sound, and your not going to find it by memorizing tablature. You might, however, get laid if you learn a Sh1tty john mayer song or something; but if you’re really rock and roll you won’t have to.
This is really crap! Everytime I hear a good new or even old song the first thing I do is look up the lyrics. As a poet and lyrical writer myself, I think I would rather people have the ability to veiw my lyrics in written text. I believe it helps people to see beyond the lyrics to the deeper meaning. What They should be trying to do is weed out the sites that have screwed up/altered or misinterpreted the actual lyrics. Thats more crap!

Is it right to destroy the careers of Young band who admire and want to cover there songs but may not have the money themselves to do so? I’m from chile, if the mpa shut down every site with tabs and lyrics I won’t be able to learn any song ’cause in my country the tabbooks aren’t available. and I cant buy them on the web ’cause I don’t have credit cards or something to pay them. if they shut down all these sites the entire world will be afected.

what a crock of shit, i cant believe this has happened, im not a rich man, i cant really afford tab books that is why i rely on tab that may not be 100% accurate but still helps me learn what i want to learn, and about depriving artist, i dont think the rollings stones, led zepplin, metallica, beatles and whoever has sold millions of albums is really stuggling that bad that they need to shut down a website such as mxtabs.net, maybe they should make a tab pay site, i would patronize, but face it, to wanna only learn one song from an artist and having to go out and buy an entire book for 24.95, us a waste of time and money, when u could pull that one simple tab from the net… so all these ass holes that took down the sites need to come up with either a tab paysite where i can purchase a sinlge tab or give us back or tab freedom, it is such ashame when the rich complain and need to get richer but taking away our rights!!! what a bunch of fucking crap, i buy cd’s i buy tab books i by the merchandise and they go and do this. ive never learnt to play guitar by chords and ive never had a guitar lesson but i now have an upcoming band who we believe can be quite big and this is all thanks to guitar tabs. i dont think they realise just how many peoples guitar playing lives there fucking up. this is insane i agree with the guys on here and im gunna show them just what stealing is.

you can’t outlaw a person’s *interpretation* of a song, which is all a tab is basically…someone listened and interpreted a song one way and put it up for others to see…creative freedom.
I used to buy CD’s in fact i bought over 800. I will be pirating every bit of music from now on and spending the money on concerts and band t-shirts.

This is stupid. I think that they shouldn’t put such a lockdown on our freedom of information. For god’s sake we’re not stealing music when we get some guitar tablatures or lyrics, and play/sing them. They have gone too far.
The other side to this is that if they shut down the sites, then people will start sharing the tablatures and lyrics by other means. They will start sharing them over p2p, online radio(maybe) and chat mediums. Any of these was not considered illegal by any means until these assholes came into play.
I have noticed that people who get their guitar tablatures online also seem to have a good number of guitar tab books as well. Before the RIAA issues, I used to buy cds - but not any more and I have plenty of the music I want (let’s just keep it at that ;D). It’d be the same thing. I guarantee that if this law becomes largely mainstream, I would NEVER buy a guitar tab book again, and further would download all of my guitar tabs illegally.
(Arrest me for playing a song on my guitar - or for that matter arrest me for singing it! I dare you MPA, I just dare you ;D).
It makes we wonder if the sound emulations that I’m downloading from the Line6 web site to my POD are legal. If I tab a song myself for my own use is that illegal? Is owning a guitar that is capable of being used in the tabbing process illegal? I would like to see everyone deluge the Music Industry Manufactures, Magazines, Press, and Artists with questions regarding the the legality of their products and how they can prove to use that they are protecting us from violating the law. For example, email Metallica and pressure the band to provide a public response to how they feel about the MPAA and the RIAA actions against the tabbing web sites. Ask Metallica if they ever tabbed or shared how to play another artists song, espcially before they were famous. Is the experience of a better player (or a teacher) showing a student how to play ‘Blackbird’ educational or illegal? We need to find out if Covering songs in a club is illegal also. What is and what is not legal? That is what we need to know. Send them all your emails. Let them know. Else you can subscribe to Guitar Player and download your 1 free song a month. The tab will be crap, and it won’t play back like PT, and you can’t print it - but that’s pretty much the industry alternative that seems to be available, sorry as it is.

Buy from a pawn shop or a used record store if you have to refuel. Just do not buy new until we get some justice. This is a crazy thing, first of all nobody is stealing anythig, all tabs are written by people who listen music and try to give a personal point of view, besides that they share music with some other guys who likes music, this has nothing to do with making money it’s about play music… MPA should be worried about making best music not about stop people sharing music. Use your head to think, not your feet.
